New Mexico Oil and Gas Association Moves EIB to Dismiss CO2 Cap Petition

After days of tedious hearings, attorneys for the New Mexico Oil and Gas Association have moved to dismiss the New Energy Economy petition.  NEE asks the New Mexico Enviornmental Improvement Board to impose a severe reduction on CO2 and other so-called “greenhouse gas” emissions in New Mexico.  The motion, which you can read in full here, argues that NEE failed to meet its burden to show that capping CO2 emissions will have any appreciable impact on global climate.  Apparently, the NEE’s key witness admitted this and said the purpose of imposing a cap in New Mexico was to motivate other jurisdictions to follow.  NMOGA argues that is an improper purpose and that the EIB’s jurisdiction doesn’t extend to motivating other states and countries by setting an example in New Mexico.  NEE will be filing a response.
